AMCP Statement on the Supreme Court’s FDA Order

Alexandria, VA., April 24, 2023 — AMCP (the Academy of Managed Care Pharmacy) released the following statement in response to the U.S. Supreme Court order regarding Food & Drug Administration (FDA) drug approval which upheld longstanding FDA approval of a therapy and its regulations while multiple related court cases work their way through the judicial process.  

“AMCP commends the Supreme Court for staying troubling restrictions on approval status and dispensing guidelines for a therapy deemed safe and effective by the FDA. These types of decisions should rest solely with the experts and scientific review bodies within FDA, and we thank the court for leaving that responsibility where it belongs.”
