HHS Rescinds Guidance on Gender-Affirming Care
- On February 20, 2025, the Department of Health and Human Services (HHS) Office for Civil Rights (OCR) rescinded prior guidance on gender-affirming care, entitled “HHS Notice and Guidance on Gender Affirming Care, Civil Rights, and Patient Privacy,” issued March 2, 2022 (2022 Guidance).
- Covered entities should no longer rely on the rescinded 2022 Guidance.
- OCR stated the rescission aligns the agency with the policy outlined in Executive Order 14187, that the agency will not promote, assist, or support the gender transition of a minor and will enforce all laws to prohibit or limit such procedures.

On June 1, 2026, the Centers for Medicare and Medicaid Services issued an interim final rule (IFR) with comment period to implement provisions in Public Law 119-21 (also known as “H.R. 1” or the "One Big Beautiful Bill Act").
